ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM

I, the undersigned, acknowledge and voluntarily assume all risks associated with participating in the activities of this escape room event. This includes, but is not limited to, any risks that may arise from negligence or carelessness by the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or due to their potential liability without fault.

Risk Acknowledgment:

I understand that participation in this activity carries certain risks, including but not limited to:

  • Use of simple tools.
  • Potentially moving or lifting objects weighing no more than 20 pounds.
  • Mental stress and anxiety.
  • Being in a reasonably small space with up to 12 persons.
  • The possibility of failing to escape the room within the allotted time.
  • The potential for falling objects.

I certify that I do not have any physical or mental conditions that would prevent me from safely participating in this activity for myself or others. I am not under the influence of drugs or alcohol that could impair my safety or endanger others.

Consent and Release:

I understand that this Accident Waiver and Release of Liability Form will be used by the organizers of this activity and will govern my actions and responsibilities during the event. I agree that the staff or authorized agents, at their sole discretion, may determine if it is unsafe for me or others for my participation to continue and may remove me from the premises by any lawful means.

In consideration of being permitted to participate in this activity, I, on behalf of myself, my executors, administrators, heirs, next of kin, successors, and assigns, agree to the following:

  • Waiver, Release, and Discharge: I hereby waive, release, and discharge from any and all liability, including but not limited to liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or any other actions of any kind that may occur as a result of my participation in this activity, the following entities or persons: the directors, officers, employees, volunteers, representatives, and agents of any and all entities authorizing this activity.
  • Indemnify, Hold Harmless, and Covenant Not to Sue: I agree to indemnify, hold harmless, and promise not to sue the entities or persons mentioned in this paragraph from any and all liabilities or claims that may result from my participation in this activity, whether caused by negligence or otherwise.

Acknowledgment of Responsibility:

I understand and acknowledge that the directors, officers, employees, volunteers, representatives, and agents of any authorizing entity are not responsible for any errors, omissions, acts, or failures to act by any party or entity conducting a specific activity on their behalf. I further acknowledge that I have inspected the facilities, equipment, and areas to be used for the escape room event and have voluntarily chosen to participate despite the risks, including the risk of falls, contact or collisions with other participants, defective equipment, the condition of the room, and any hazards posed by spectators or volunteers.

Medical Consent:

In the event of injury, accident, or illness during this activity, I hereby consent to receive any medical treatment deemed necessary.

Infectious Disease Warning:

I acknowledge that there is an inherent risk of exposure to COVID-19 in any public place where people are present, and I voluntarily assume all risks related to such exposure.

Alcohol Policy:

Alcoholic beverages are not allowed during regular business hours. The staff reserves the right to refuse entry to anyone who is intoxicated upon arrival. No refunds will be provided in such cases, as the safety of our staff and guests is paramount. Additionally, the games are challenging, and you will perform better if you are sober and fully alert.

Media Release:

I grant Mystic Realm Escape and its assigns, the right to use any photos, video footage, or sound recordings of me taken during the event for marketing purposes.

No Refund Policy:

I fully understand that there are no refunds under any circumstances once I have purchased my entrance fee.

Binding Agreement:

This Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I CERTIFY THAT I HAVE READ THIS DOCUMENT AND FULLY UNDERSTAND ITS CONTENT, AND AM NOT UNDER THE INFLUENCE OF ANY SUBSTANCE WHICH MAY ALTER MY ABILITY TO UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT, AND I SIGN IT VOLUNTARILY AND OF MY OWN FREE WILL.  I FURTHER CERTIFY THAT I AM 18 YEARS OF AGE OR OLDER, OR THAT MY PARENT’S OR LEGAL GUARDIAN’S SIGNATURE IS BELOW.

WHEN REGISTERING ONLINE, MY ONLINE SIGNATURE SHALL SUBSTITUTE FOR AND HAVE THE SAME LEGAL EFFECT AS A SIGNED WAIVER AND RELEASE AGREEMENT.
